1. About these terms

These Terms and Conditions govern your use of the website brandofluence.com and the Brand-O-fluence platform, owned and operated by Fulminous Software Pvt Ltd, a company registered in India ("we", "us", "our"). By creating an account or using the platform, you agree to these terms. If you do not agree, do not use the platform.

2. Eligibility

You must be at least 18 years old to use Brand-O-fluence. By registering, you represent that you meet this requirement and that all information you provide is accurate and kept up to date.

3. Our services

Brand-O-fluence is an online platform that connects brands with social media creators ("influencers") for paid marketing campaigns. Brands can discover creators, view their audience analytics, invite them to campaigns, review deliverables and pay for completed work. All services are delivered digitally; no physical goods are sold or shipped.

4. Pricing and payments

The price of each collaboration is agreed between the brand and the influencer on the platform and is shown to the brand before payment. Brand-O-fluence currently charges no platform fee, commission or subscription to brands or influencers: the brand pays only the agreed collaboration amount, and the influencer receives that full amount. If we introduce any fee in future, it will be shown clearly before payment and these terms will be updated first. All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.

Payments are processed securely by PhonePe Payment Gateway. We do not store your card, UPI or bank details. Fulminous Software Pvt Ltd holds the campaign payment until the brand approves the deliverables, and then releases the full amount to the influencer.

5. Cancellations and refunds

Cancellations and refunds are governed by our Refund and Cancellation Policy, which forms part of these terms.

6. Your content

You are responsible for all content you submit to the platform. You must not submit content that infringes third-party rights, violates applicable laws, or violates the policies of any connected social media platform.

7. Prohibited use

You must not use the platform for fraudulent or unlawful purposes, misrepresent your identity or audience, buy fake engagement, attempt to take payments for platform collaborations outside the platform, or interfere with the security or operation of the platform.

8. Account suspension and termination

We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or otherwise misuse the platform. You may close your account at any time from the account deletion page.

9. Limitation of liability

We facilitate collaborations between brands and influencers but do not guarantee the performance or outcome of any campaign. To the extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the platform, and our total liability for any claim is limited to the amount paid through the platform for the collaboration in question.

10. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last changed. Continued use of the platform after a change means you accept the updated terms.

11. Governing law and jurisdiction

These terms are governed by the laws of India. Any dispute arising from them is subject to the exclusive jurisdiction of the courts at Jaipur, Rajasthan.

12. Contact and grievances

For questions or complaints about these terms or the platform, contact us. We acknowledge grievances within 48 hours and aim to resolve them within 15 days.
